1. Agreement to these terms
These Terms of Service govern your access to and use of PortfolioFit, including its website, portfolio workspace, APIs, remote MCP server, and plugin. By creating an account, authorizing an agent, or using the service, you agree to these Terms and the Privacy Policy. If you use PortfolioFit for an organization, you represent that you are authorized to accept these Terms for it.
2. What PortfolioFit does
PortfolioFit helps structure investment mandates, normalize portfolio holdings, compare holdings with mandates and constraints, perform supported calculations, identify evidence gaps, and generate explanatory guidance. Features may be deterministic, model-assisted, or a combination of both.
PortfolioFit does not hold assets, execute orders, place trades, rebalance an external account, or guarantee that a portfolio complies with a mandate or law.
3. Accounts and agent authorization
Provide accurate account information and keep passwords, authorization links, tokens, and connected devices secure. You are responsible for activity performed through your account or an agent you authorize. Notify us promptly if you suspect unauthorized access.
You may disconnect agent access through the relevant client. We may require reauthentication, restrict scopes, or revoke tokens when needed to protect the service or your account.
4. Your content
You retain your rights in mandates, holdings, files, prompts, and other content you submit. You grant PortfolioFit a limited right to host, process, reproduce, transform, and send that content to service providers only as needed to operate, secure, and improve the requested service and provide support.
You are responsible for having the rights and authority needed to submit content, and for avoiding personal, confidential, regulated, or third-party information that is not necessary for the analysis.
5. Acceptable use
You must not:
- use PortfolioFit unlawfully, deceptively, or to violate another person's rights;
- attempt to bypass access controls, plan limits, authorization scopes, or security measures;
- probe, disrupt, overload, reverse engineer, or introduce malicious code into the service;
- share access credentials or tokens with unauthorized people;
- misrepresent PortfolioFit output as a regulatory approval, audit opinion, or guaranteed fact; or
- use automated access except through documented or authorized interfaces.
6. Important analysis limitations
PortfolioFit output is analytical assistance, not investment, legal, tax, accounting, compliance, or regulatory advice. It does not create a fiduciary, adviser, broker, auditor, or attorney-client relationship. Model-assisted output may be inaccurate, incomplete, inconsistent, or based on ambiguous or missing evidence.
You are responsible for checking source documents, normalized holdings, calculations, citations, assumptions,
and suggested remediation. Obtain qualified professional review before making investment, legal, compliance, or
trading decisions. A status such as compliant or non_compliant applies only to the
supplied mandate, holdings, evidence, and supported checks; it is not a legal or regulatory determination.
7. Third-party services
PortfolioFit relies on third-party services for model processing, authentication, payments, email, analytics, and hosting. Their services may be subject to separate terms and availability. Our Privacy Policy explains the categories of information shared with them.
8. Plans, limits, and billing
Features and limits may vary by plan and may be measured by invocation, token, page, compute, or another stated unit. Current limits and renewal information are shown in the service. Replaying an idempotent request does not create a new completed invocation when PortfolioFit identifies it as the same request.
Paid plans purchased on the PortfolioFit website are processed by Stripe. Prices, billing periods, taxes, trial terms, cancellation options, and any refund terms are shown at checkout or in the relevant plan screen. Unless required by law or stated otherwise at purchase, charges already incurred are non-refundable. Agent clients do not purchase or change a PortfolioFit subscription on your behalf.
9. PortfolioFit materials
PortfolioFit and its software, interfaces, branding, documentation, and service-generated materials are protected by applicable intellectual property laws. Except for rights expressly granted in these Terms, no rights are transferred to you. You may use your exported results for your internal purposes, subject to any third-party rights in the underlying content.
10. Availability, changes, and suspension
The service may change, experience errors, or be temporarily unavailable. We may add, remove, or modify features, capabilities, models, limits, and plans. We may suspend or terminate access when reasonably necessary for security, abuse prevention, non-payment, legal compliance, or a material breach of these Terms.
You may stop using PortfolioFit at any time. Contact support@portfolio.fit for account-level deletion or access requests. Some records may be retained as described in the Privacy Policy.
11. Disclaimers and responsibility
To the extent permitted by applicable law, PortfolioFit is provided on an "as is" and "as available" basis, without warranties that results will be complete, accurate, uninterrupted, secure, or suitable for a particular purpose. You remain responsible for decisions, filings, reports, trades, and actions taken using the service.
To the extent permitted by applicable law, PortfolioFit is not responsible for indirect, incidental, special, consequential, or lost-profit damages arising from use of or inability to use the service. These Terms do not exclude rights or liability that cannot lawfully be excluded or limited.
12. Changes to these terms
We may update these Terms as the service or legal requirements change. The revised Terms will be published here with a new date. If a material change requires notice or consent under applicable law, we will provide it through the service or by email.
